General Information

 

Liberty Township Zoning

Liberty Township regulates building and land use in the unincorporated area, pursuant to authority in the Ohio Revised Code and the adoption of a zoning resolution ratified by voters in 1960 and subsequently amended from time to time.  The purpose of zoning is to protect the health, safety and welfare of township residents while providing for the orderly development of the township.   

 

The Resolution requires that landowners in the unincorporated area of the township secure permits before building commercial structures and houses and additions thereto, including rooms, decks and porches, and other structures, including outbuildings, such as barns and garages; swimming pools; signs; and fences.  Violations may subject the violator to fines of one hundred dollars per day for each separate offense.  Agriculture is generally exempt from zoning as a matter of law.   

The Zoning Office issues permits for structures and uses that conform to the Zoning Resolution and enforces the Resolution.  Permits for structures and uses that do not conform to the Zoning Resolution can be issued pursuant to an order from the Board of Zoning Appeals.  Permits for structures on parcels of property that abut state highways may also require approval from the Ohio Department of Transportation.

  

Zoning Commission

The Zoning Commission consists of five members, plus an alternate.

The Commission prepares the Zoning Resolution and schedules and holds public hearings on:

 

  •   Requests for rezoning concerning individual lots and planned unit developments.

·         Proposed text amendments to the Resolution that are initiated by the commission, transmitted from the Board of Trustees, or submitted by owners and lessees of real estate.

Upon completion of the public hearing process, the Zoning Commission considers the evidence presented, together with recommendations of the Fairfield County Regional Planning Commission, and makes recommendations to the Board of Trustees concerning planned unit developments, changes in the text of the Zoning Resolution and re-zoning matters.  The Board of Trustees conducts a public hearing and may approve, approve with modification, or reject the recommendation of the Zoning Commission.  Decisions of the board are subject to a 30-day referendum period.

Board of Zoning Appeals

The Board of Zoning Appeals consists of five members, plus an alternate.

The Board is a quasi-judicial body that holds hearings, deliberates and decides matters involving requests for variance from a strict interpretation of the Zoning Resolution, requests for conditional uses specified in the Zoning Resolution, and appeals of decisions by the zoning officers.  Applicants have an opportunity to present testimony, evidence and witnesses and be represented by counsel.  Decisions may involve approval, approval with conditions or limitations, or denials.  Appeals of decisions of the Board of Zoning Appeals may be heard by the Court of Common Pleas.

Zoning Hearings and Meetings

 

The Zoning Commission regularly meets on the second Tuesday of each month 

at 7:30 p.m. at 816 W. Market St . 

The Board of Zoning Appeals meets on an irregular basis, as hearings are scheduled.

·     Reviews plans for driveways to ensure design allows for access and egress of emergency vehicles.  Works with land owners on establishment of dry hydrants on ponds.  Makes available light-reflecting house numbers for mail boxes for a small fee to enable emergency responders to quickly find the house.  (House numbers are assigned by the County Engineer ’s Office, which also issues mailbox permits for addresses on county-maintained roads.)

Plumbing Permits, Registration, and Inspections – Residential and Commercial

Plumbing inspections are required for:

1.  New homes and new accessory buildings that contain plumbing and

2.  Alterations and Additions to residential homes or accessory buildings built on or after March 1, 2006 and that involve alterations to piping or fixtures. 

            3.  All commercial buildings.

Water and Septic or Sewer Systems  

Zoning permit applications for houses, bedroom additions, and accessory buildings containing bathrooms require evidence of publicly provided water and sewer or plans approved by the Board of Health for water well and septic systems that are adequate to accommodate the new facilities. Plumbing inspections may be required. (See above.)
